You'll probably get half of the rebate amount. The rest will go toward your spouse's debt.

With federal taxes, it doesn't matter if you are in a community property state or not...
As long as you filed joint return, you would one-half of the amount of the total refund due...the other half would go toward the offset, which I am guessing is probably old student loans. That is the best way the Government has of collecting loans and child support these days.
