We met and married in Mexico. He is still there and can't seem to gain legal status in the USA. Any suggestions. I am unable to move there because of my elderly parents.What are the steps for my Mexican spouse to gain legal status?

If your spouse has never been trouble with the law, you can petition for him to join you in the states. Here's the step by step guide.

In short:


File a I-130. Keep a box or binder where you keep all correspondance with the INS regarding your petition. Send it to the address listed under 'Mail to USCIS', using the correct one for the state you are living in.





You'll receive a NOA1 (notice of action 1), indicating your application has been received, and placed in the queue.





File an I-129F(also known as a K3 visa) - it's free, and once approved, your spouse can use it to enter the USA while waiting for a decision on the I-130.





Once approved and settled in the US, you file an I-485 (adjustment of status) form, and when that is approved, you will have your permanent resident card, if you've been married more than 2 years. If less, yours will be conditional until you are, and then you can apply to remove the condition.
