My spouse owe back pay for child support and it is taken from his paycheck, will he get a rebate check?

The IRS sent a letter saying he is entitled to $600, and that he should expect it may 16th in the mail.

Unless child support doesn't tell the IRS he is arrears you should get the whole check. Now sometimes CS will jump in and say someone is in arrears and take part or all of a tax refund (I am not sure about the stimulus refund).





For example my brother paid his child support every week via a deduction from his paycheck. He then got custody of the child because the mother didn't want to hassle with the kid anymore. CS still took all his income tax refund because at one point 5-6 years ago his ex had applied for food stamps and a medical card and a check for her and her children. The CS took my brothers refund to ';pay back'; the state for her assistance. I just didn't think this was right but his lawyer said it was. I guess she forfeited her CS checks in order to get assistance from the government and now they want the money back.My spouse owe back pay for child support and it is taken from his paycheck, will he get a rebate check?
The rebate check is subject to the same rules as far as offsets as a normal tax refund. So if they were going to take his refund money for back support, then they are also going to take the rebate check for back support. Of course all depending on the back balance of his support. If they weren't even going to consider taking his refund, then he wasn't far enough behind for them to warrant an offset, and won't touch his rebate either. Or if his tax refund covered all the back support, then they won't take the rebate. But if his back support is over $500, they took his refund, it didn't cover it all or he didn't have a refund to take, then they will take all or part of the rebate as well to try and take care of the rest of the back balance. So it is possible that they will take the rebate, but without specifics on your dollar amounts, I can't be sure.
They should be taking them and applying them to any outstanding state or federal monies owed....but as many error's as they have had with these things he might just get it.
No, don't expect it. It will most likely be taken and applied to what he owes. It's treated like any tax refund.
as long as HE claimed that child on his last years tax return then you will get that money in stimulus check
